  • Outside Sales Florida Vacation

    Please help me with a bet. My employer is telling me there is a new way to calculate an outside salesmen's vacation time. You have to use their gross wages for 3 months with commissions to get the rate to pay them per hour.

    I have not heard anything about this.

    Has anyone else?????

    Although Florida is not my state, I've never heard of it. Even the states which tightly regulate vacation don't, to my knowledge, mandate how vacation pay for commission-only employees must be calculated. And considering that Florida has virtually no wage and hour laws of its own (only a higher-than-federal minimum wage), I seriously doubt it.

    Having said that, therefore, the employer can basically use any calculation he/she wants.
