    I worked for a firm in Indianapolis through 2/12/09, the date I was laid off because of a lack of business. My last paycheck was the W/E 1/31/09. On 2/15/09 the partners contacted me and I was informed that they would not be paying any of my time worked or accrued vacation time. I filed a complaint with the Indiana Department of Labor 6 weeks ago and have heard nothing. What am I eligible to file for in small claims court. I have heard that I am eligible up to treble damages, court costs and attorneys fees. On another website it said double damages.

    I have since been informed that the partners have started a new business under a new name. What are my options.

    Have you tried to contact the state DOL regarding the status of your claim? You are certainly free to contact an attorney. In some states, you would have to void your state claim if you pursue this civilly, but Indiana is not my state and I don't know if that is true in Indiana.

    An attorney should be able to advise you as to what you can or cannot include in a civil suit. To my knowledge, we have no Indiana attorneys responding here.

      Per my reference, in Indiana if you decide to pursue private legal action to collect wages claimed after filing a wage claim with the In. DOL, you need to let them know. They will close your file/claim with them.
