    Can an employer force an employee to change from a non-exempt employee to change to an exempt employee without that employee's approval, If the employee was hired as a non exempt employee and there rate of pay and there job duties have not changed. and does the situation change if that employee's position qualifies under the Computer Employee Exemption

    As long as the job qualifies as exempt, the employee's approval to make the change is not required.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      Agreed. I have included a pointer to the actual rules and the consent of the employee is not one of the conditions. It might be worthwhile however to read the factsheet and see if all of the other rules are being complied with.
