  • on call law

    me and another guy have to be on call with a cell phone everyother weekend and we have to take the call without letting it get to voicemail, i was just wondering if i am supposed to get paid for this? The other guy is a part timer around age 23 that puts in around 25 hours a week and i didnt think part time workers could be on call over a weekend/nights? anything would help i cant find anything on it in northdakota laws website?

    This is legal under federal rules as long as paid hours worked start as soon as the phone is picked up.

    I have no idea what rules (if any) your state has on this subject. Most states just follow the federal rules as is in this area.
