  • Eight hour shift, one hr lunch or half hr CA? California

    I am a full time hourly employee in California, I was tooled by my coworker that does time cards that by law I have to take an hour lunch if I work any where form a six to eight hour shift.

    Is this correct? or can I just take a half an hour lunch.

    Example if I come in at 8:30am take half an hour lunch and leave at 5pm I have worked and eight hour shift right? i don't have to take an hour lunch right?

    The law only requires a half hour lunch. However, the employer has the perogative of requiring a longer one. If the employer says you take an hour lunch, then you take an hour lunch. He cannot require you to take less than the law requires, but he can require you to take more than the law requires.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
