  • PTO buyout at 75% rate in Massachusetts

    Our new owners just changed the PTO policy effective 1/1/09. Our PTO under the new and old plans will be tracked separately (we will continue to accure under the existing plan through 12/31/08).

    I have hundreds of hours accrued under the old policy. I can either use-or-lose those hours over the next two years (12/31/10), or I cash in ALL (not part) of it now (1/1/09) and get paid 75% face value.

    As it isn't realistic for me to be out on PTO for that many weeks (my current balance plus the new accrual) over the next two years, aren't I kinda being forced to sell-out at the lower rate?

    Also, we can only carry over 40 hours yearly under the new plan...

    Does this make sense?

    Duplicate post. When someone who knows the answer to the question comes on line, they will respond.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      I wasn't sure I posted it in the correct forum the first time, and I reworded my question a bit to make it clearer (or so I think). I'm not planning on making it a habit to cross-post.
