  • Terminated, But Vacation was paid 17 days later ? California

I was Terminated Sept 1st, and was paid an estimated final check that day "I work on comission + Salary - Expenses" However they did NOT pay me my Vacation ?? I called 10 days after to ask where my vacation pay was, the HR said she need to check with the General manager, and a week later i got a certified letter in the mail with my Vacation Pay check. shouldnt it be Paid immediately at Termination Day ? If so what am i entitled to ?

Assuming this was an involuntary termination, yes you should have been paid your vacation (plus all wages and other compensation that could be reasonably and accurately calculated at that time) on your final day.

You can file a claim for waiting time penalties with the Division of Labor Standards Enforcement. It may be a long wait, though, budget cuts have really crippled many state agencies, including the DLSE.
