    Our employer is telling us that it is against Colorado Labor Law to hire an employee on a salary at a day care center if that employee does not hold a degree or credential in Early Childhood. Is there really such a regulation? I worked as a paraprofessional in the public schools for years on salary.

    It isn't illegal to pay them on a salary basis but it would be illegal to classify them as exempt. Translation, they would still get OT. It is by far easier to pay hourly in this case rather than on salary.
