  • Kentucky Rest Requirements

I work in several different states and will be working in Kentucky this week. In Kentucky it says that for every four hours worked you get a 10 min break. My boss says he doesnt have to give us breaks because we get a one hour lunch. we sometimes work 12 hour days with just the lunch. the lunch is also not paid. Can he do this?

Adult employees in Ky. are entitled to a paid 10-min. break for every 4 hrs. worked & a "reasonable period" for meals (ordinarily 30 min. or more) no sooner than 3 hrs. or later than 5 hrs. into the shift. Meal breaks are unpaid as long as they are duty-free.

Let's try one more time. Work 4 hours before lunch, get a 10-minute break sometime during that 4-hour period. Take lunch. Work 4 hours after lunch, get a 10-minutes break sometime during the second 4 hours. Lunch is NOT a rest break.
