    As Scott noted, this employee can be fired - however, that is the employer's decision to make.

    Doctor's notes are fine, but FMLA and ADA issues aside, this person can be fired. The notes from the doctor are not a requirement for the employer to excuse the absences. Warnings are nice. Ineffective, but nice and they may help when the termed employee files for unemployment.

    I work in a place where there is only 5 employees. One girl is about to go on maternity leave, two others have another job so can only work around their other schedules. We have a girl who is constantly missing work and bring in a doctor's excuse. She was supposedly quarantined for MRSA, yet was seen drinking in bars. Besides not doing her job when she is actually there, she has worked maybe 2 weeks out of the last 3 months with her different illnesses. They think they have to keep her since she has doctor's excuses, but I cannot and will not keep working doubles. What are the laws on this?
