    First off, I apologize for revisiting a topic from a previous thread (my original thread is here).

    I'm at the point now where I'm scheduled to have a hearing with my previous employer with the Labor Commision regarding what I believed to be an illegal deduction from my final paycheck. They claim they can deduct from my final paycheck what they "overpaid" me in sick time I took during 2007 (see my previous thread for details).

    Does anyone have any information that may be helpful when I present my case at the hearing?

    Pull this DLSE Opinion Letter out of your briefcase and show it to the hearing officer. It should garner you a few points. http://www.dir.ca.gov/dlse/opinions/1999-09-22-1.pdf
