      Ok, maybe I mis-worded my question.........

      If the Labor board denies a claim, Is it still possible (legal) to get a laywer and sue?

        There is nothing in the law that prohibits you from trying.

        Whether or not you would prevail is too situation specific to say.
        The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
