  • Salaried Employee - Sick Days/Half Days California

    I am a salaried employee. I do not receive overtime. I recently went home ill after 3 hours worked, yet was told that since I didn't have any Sick Pay acfrued, I would not be paid for the day.

    Is that true? I was under the influence that if I worked anytime in a given day, I had to be paid my regular salary?

    Can you also tell me the labor code that backs this up?

    If you are an exempt employee you must be paid your full pay for any day in which you perform work unless the reason you miss the partial day falls under FMLA. As you went home ill, it is not clear whether or not you were covered by FMLA or not.
