    That depends on state law. Federal law does not require that employers even offer vacation or sick time. State law follows suit; however some states have added that time should be paid out in accordance with company policy. Some other states have provisions that accrued but unused vacation must be paid at termination. Your situation is a bit more complex because you work across multiple states.

    In Delaware, final wages include accrued vacation (when vacation is offered via company policy, contract or CBA).

    In Minnesota, final wages include vacation (when vacation is offered under an employment agreement or company policy).

    It's my opinion that the rules of the home-base state would apply on the vacation question. Pattymd do you agree?
