  • Township Policeman and COBRA Pennsylvania

    I have a friend who was lost his job as a policeman in a township in PA. They told him he can't get COBRA since they don't have 20 employees. I know this is the law for private employers, but is it the same for public sector, non-federal employees?

    A quick search does not show that the laws regarding COBRA are any different for public employees in PA, with the possible exception of school employees in some limited situations.

    So yes, what he was told appears to be correct.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      I figured as much. All the information I could find on the DOL website started with the 20-employee threshhold.
