  • Pay/Additional benefit in return for future service commitment/perceived commitment.

I have a slight difference of opinion with my non-profit ED.
    1. An exempt employee made a (great) case for additional pay for additional responsibilities handled in the past. My ED agreed but responded with paying 50% now and 50% next year. All employees are at-will and the employee made a case for past work and ED agreed it was for past work. The ED is just trying to improve retention.
    2. ED made exceptions to allow additional professional development funds to certain employees then asked me to update our policy with a statement to the effect that exceptions might be made based on "Expected longevity in role". Again, all employees are at-will and to be clear they are not referring to past years of service.
Any thought or any resources that can clarify any legal issues involved? Thanks!
