    I was terminated in October due to lack of work and my boss saying she couldn't afford me. Today I was online and saw an ad that she had listed looking for someone offering the same salary plus the occasional overtime. What can I do?

    You can apply for the position (if the company allows rehires).

    There is no law that states your position cannot be filled after you have been termed due to budgetary concerns.

    Some unions have clauses in their contracts about being recalled. So unless there was a contract which covers this, you have no recourse.

      Maybe worked picked up but no matter what the info in HRinMA's post is correct.
      Reapply & see what happens if they allow rehires.
