  • Employer Posted Opening on Craigslist then Laid Off an Employee California



    Employer has been informing employees for at least the pass couple of months that the company will be growing, possibly double it's current size. Only thing pending is a multi-million dollar contract that needs to approved from a client. A couple of weeks ago, the company started posting job openings. Later that same week, the same employer "laid off" an employee that has been there for a couple of years and already has the skill and experience they are looking for. They informed that employee it was a "reduction in workforce".

    I understand that employment in California is "at will" and that employees can be terminated for any reason but isn't this wrongful termination or something to that degree? They basically lied to that employee.

    Sorry, but based on your post, the employer did nothing illegal. (unless the employee had a binding employment contract or CBA with some type of "guarantee of employment.")

      A wrongul termination means that the employee was terminated for a reason prohibited by law. No law prohibits an employer from lying to an employee - no law prohibits an employee from letting an employee go while still hiring.
      The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
