    I wonder if i should have been fired for comments and language that i made while i was off the clock (hourly emp) not on the property and no customers in ear shot. I was termed from a lg Retail chain for this, the only people who heard these comments were Assit mang, one employee,& dist ops mng who was on the other end of a cell phone with assit mng Did not threaten anyone or make durogtory comments about co or any person just process

    NV is an "at will" state thjis means you can be terminated at any time for any reason long as it violates no law. This means yes they can terminate you. Unfair and unlawful are two serperate issues

      Whether you "should" have been fired is not something we can evaluate from here with the information available to us.

      But you legally CAN be fired under the circumstances you describe, whether you SHOULD be fired or not.
      The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

        Even though you were not on the property & no matter who did or did not hear your comments, this is not an illegal termination. You can be fired in an at-will employment state at any time for any reason that is not protected by law (ie age, religion, gender) or unless you had a bona fide employment contract or CBA to the contrary.

        By the same token, you could have quit your job at any time for any reason in an at-will employment state w/o a contract to the contrary.
