  • STD FMLA Unemployment denied..what now? Michigan

    I have been on LOA for about 5 weeks..STD denied me and said it was covered by work Comp..Work Comp denied me...FMLA is running out...after FMLA is gone I have to go back to work yet I can’t go back because the job is the reason I am off - STRESS...Am I entitled to unemployment? I am soooo lost because I don’t have any money and behind on all my bills

    That's a question only the state can answer. But if you're not medically cleared to work, it's questionable at best.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      It's the state's decision whether you receive UI benefits but you have to be ready,
      willing & able to work/looking for work.

        You said you have been on LOA for 5 wks. & FMLA is running out. How much total
        time have you been out on FMLA? FMLA can go up to 12 weeks in each 12 mo. FMLA period if you
        medically qualify.
        However, FMLA is unpaid job protected leave.

          I have intermediate so its 12 weeks and I had to recertify each yr. When I re-applied I only got 7 or 8 weeks.

            When your FMLA time runs out, your employer can terminate you if you cannot
            return to work.

            Also, re UI benefits - as we mentioned previously, it would be up to the state to
            decide if you qualify for them & you do have to be medically able to work.
