  • Anxiety Disorder (PTSD) Eligibility for SDI in California


    Does anyone concretely know if a person who has been diagnosed by a Psychologist with an anxiety disorder(specifically post traumatic stress) is eligible to receive state disability insurance in CA?

    This person is currently unemployed receiving unemployment insurance benefits.

    I'm trying to do find some info for a family member and there seems to be very little information on this specific topic available anywhere on the web, that I can find.

    Does anyone have a recommendation for a website that might have the answer?

    First off, you generally don't get UI unless you are ready, willing & able to work/looking for work. Can this person work - are they looking for work?

    Re SDI Ca.:
    You may be eligible for Ca. SDI benefits if you meet all of the following criteria:

    You are unemployed and disabled. (includes pregnancy)
    You were working when you became disabled.
    You are unable to do your usual work because of an illness or injury.
    You worked in covered employment.
    You have a physician's certificate supporting your claim.

    re disability - SDI defines disability as “any mental or physical illness or injury which prevents you from performing your regular and customary work”.

      Thanks for the response. Do you (or anyone else) know if this is the extent of the criteria? Seems like through the SDI claim process there would be some scrutiny placed on whether the type of illness, mental or physical, would prevent you from working even if you have a physician's certificate. Does anyone know more about that and how Post Tramatic Stress is evaluated/viewed by SDI?

        Mental disorders, including PTSD, are considered compensable by SDI. Certification may be made by a licensed physician, surgeon, US government medical officer, osteopathic physician, chiropractor, podiatrist, optometrist, dentist, designated psychologist, or accredited religious practitioner, and in normal pregnancy related claims, a nurse midwife, nurse practitioner, and licensed midwife.

        I personally have had employees with depressive disorder, OCD, and PTSD receive SDI benefits. Hope that helps.

            ?             To be eligible for SDI benefits, all you need is a qualifying physician, or another provider recognized by EDD/SDI to certify you are ''disabled'' under their rules.

            SDI doen't evaluate the condition. If there is a question to eligiblity, they will seek evaluation from a Dr of their choice. If denied benefits, you can appeal through the prescribed administrative law process.

            Broken leg, PTSD, doesn't matter. Eligibility is based on Dr medical evidence. Just make the application... this must be submitted within 49 days of becoming 'disabled', or you'll be denied and have to appeal. The folks at EED will help with the dates if necessary to maximize benefits.

              For whatever reason, the 'edit' isn't working today... so,

              ... you didn't say the cause for the PTSD diagnosis.
              If the Dr/psych feels there is industrial causation, a claim for workers compensation benefits must be filed with the employer. This isn't a ''if I want to", the law requires it.
              Treating physicians are not always up on the WC statutes, nor quick to bill an employer/carrier, due mostly to the fee schedule. There's more money in private pay or GHP than WC.
