    An employee is going to be taking maternity leave in NY.

    The company is requiring the employee to exhaust all Vacation and Personal Time at the time she leaves(approx. 2-4 weeks before delivery).

    Employee plans on applying for STD post delivery.

    Does FMLA run concurrent with STD in NY? (I'm new to NY labor laws-from CA)

    There is no PDL in NY, correct?

    Absolutley, FMLA runs concurrent with STD. STD is an income replacemenet program, where FMLA is the leave. As far as I know New York doesn't have a PDL, but someone will be along to clarify that portion of your post.

        I agree with mlane58 - The STD will run concurrent with FMLA. The STD will provide income while the employee is out on unpaid job-protected FMLA leave.
