  • LOA in NEW YORK New York

    I have an employee who has needed to alter their work schedule due to constant headaches and elevated blood pressure(Doctor's Orders). This was in the past and accomodations were made for this individual to work 2 days from their residence and 3 days at the main place of work. However the agreement was only for 2 months, which has since expired.

    This individual continues to have these problems and is costing the organization valuable time and $$.

    How can the organization legally approach the subject of a possible LOA?

    This person may request a LOA voluntarily, but what are our options if they don't?

          Yes you may.

            What are my options if this person does not want to take FMLA?

            Can I mandate her to take a LOA/FMLA?

              If working PT and or from home is not working for you, you can require that FMLA be taken insyead. However, if this person is still able to work 3 days a week from the office, you must permit them to continue doing so. The other 2 days would be FMLA. You may transfer them to another position while intermittent leave is required.
