    I need to have surgery and will be out of work a subsabtial amount of time. Can I draw either disability or unemployment while in Texas recovering?

    Unemployment, no, because in order to collect unemployment you have to be able to work and actively looking for work in order to collect.

    Disability, that depends. Texas does not have a state disability plan and you would not qualify for SSDI. However, if either you have purchased privately or your employer offers (and you are covered under) a group disability plan, you may be able to collect from that, subject to plan requirements.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
