how early do u have to file on someone if they are suiing you?..couple years? a year? or what?

You might want to furnish some additional details, to get someone who might be able to help you, including who is suing who & for what & the time line (when did this all happen) etc. Thanks.

Is he suing just for damage to the van or for personal injuries - thanks.

        (Has he actually sued you?)

If you are actually being sued & you have not already done so, you need to inform your ins. company & they will go from there.

The SOL on damage to personal property in Ca. is generally 3 years.

If he sues you, then you will have to go to court unless possibly you can settle before then.
