  • Need some help with the Ch13 Plain

    Hi im disabled and received a small house after my parents passed. I
    thought it was clear but but found out after probate that the
    mortguage company had it listed at shariff sale the loan has a 3,000
    ballance. I filed ch13 to stop the shariff sale but it was dismissed
    because i didnt file my ch13 plain. I had everything else filled just
    couldnt find out any thing onlin about a ch13 plain?

    As i said im disiabled and dont haven the money for a lawyer , im on a
    fixed imcome and everyone i contacted wanted payments of 3 to 400 a
    month for the plain.

    Im currently living in the house and if i lose it i will be out on the
    streets.

    Chapter 13 cases are very difficult to do without an attorney. Given your
    circumstances, you may be able to have a lawyer at a law school or through
    your bar association take your case for a reduced or no fee.

    Additionally, some states have "form" Chapter 13 plans. I don't know if your
    state is one.

      Need some help with the Ch13 Plain

      I don't know what state you are in, so I'm not sure what options are
      available to you in your state. In some areas, there are housing assistance
      counseling organizations that can usually work something out with a mortgage
      company. If the amount owed is only $3,000 there must be some way to use
      the home's equity to borrow enough money to pay off that mortgage and get a
      new one with a long term payout. Also, maybe you can do a "reverse
      mortgage" where you borrow against the equity in the house and receive
      monthly payments to you from the mortgage company. Talk to a mortgage
      broker about this or any other kind of refinancing options that might be
      available to you. You could also do a sale/leaseback where you sell your
      property to an investor who leases it back to you. You get the cash, but
      you have to pay rent after that, and you get to stay where you are.
