    My employer hasn't paid me in 2 months and isn't giving me a date when I will be paid. I am worried that he is stalling until he files bankrptcy. The business is a "c" corp in CA. I have filed a claim with the CA labor board but it is going to take months before they even hold a hearing on the matter.

    Here are my questions....

    1. Does BK get them out of paying my wages

    2. If they do file BK I understand from another question that I have to file with the BK court, but how do I know if they have even filed?

    3. is there any way to go after the owners personally for my back wages?

    If you aren't paid your back wages before they file for bankruptcy, you will have to put in a claim for you wages with the corp. bk estate. You can verify if they filed for bk by checking with the court in county the corp. is located - it's public record. A c corp. is a separate entity from those that own it & they have very limited (if any) personal liability for corporate debts.
