    I just found out today, that the idiot who hit me was arrested either that night or the next day and was in jail for 2 weeks on drug charges. Will his insurance company still defend him up to his policy limits? The limits are 100k/300k. Or is this one of them bad faith things that an insurance company could get away with? Now, I know why when we were waiting for the cops to come he asked me, "if I was going to sue him too?" So, maybe someone else already sued him, I don't know for sure. Can an insurance company at this point basically just not defend him?

    If he had ins. & it was in force, the ins. co. should still defend him up to his policy limits.
