Angry Fired with Dr's Note

Hello, I live in the state of Vermont and here is my story..

First I must tell you that I was on probation for my attendence until July.

On Sunday, April 23rd, when I woke up at 12:00pm to go to work, I was very dizzy and I Have a 45 minute drive to work. I called work and told them that I would be in later since I can not call in sick. When I woke up at 2:30pm, the second time, I was still lightheaded, but drove to work. I got to work at 3:30pm and worked until 7:30pm, not my full shift. I went to the emergency room to see why I was getting dizzy and lightheaded. At that point, I was told that I had Vertigo, inner ear problem. The emergency Dr wrote me a note stating that I would be out for the next 2 days. When I got home at 10:00pm, I called work to let them know that I would not be in for the next 2 days and that I do have a Dr's notes. I also called the next 2 days to tried to talk to my head supervisor, but she NEVER returned my calls.

When I returned to work on Wednesday, I was called in the Human Resource office and was told that I was fired because on my attendence. Can a company fired you with a Dr's note and can a company tell you when you can take sick time and when not to?

Outside of situations where the leave falls under the Family and Medical Leave Act (FMLA), a doctor's note has no force in law. So, yes, a company can fire you even though you have a doctor's note -- particularly if you are already on probation for attendance issues.
