Default MD non-compete...enforceable?

I work for a software company in MD and recently had the opportunity to switch positions within the company. Part of the deal is that I am required to sign a non compete agreement. I have refused to sign this agreement in the past because it is very broad and therefore, if interpreted as such, very restrictive. There's no geographical specification, I'd assume because we have clients and competition across the U.S. The agreement is binding for 3 years after departure from the company, regardless of whether or not I quit or am fired for any reason. I would not be able to work with another company that has products or services that are directly or indirectly related to my employers line of products and services. How enforceable are these type of contracts in MD?

The devil in non-compete agreements is in the details. You really should have an attorney versed in this area advise you. The employer can make signing the agreement a condition of employment; but if the agreement is not enforceable, in whole or in part, you would likely not be held to the nonenforceable clauses. Really, though, seek the advice of an attorney.

I will tell you that reasonable non-competes are enforceable in MD. As Patty said, the devil is in the details and no one here can tell you whether yours is nor not. You will need to see a lawyer for that.
