Angry Unsure New Mexico

I was given a written warning regarding a situation that happen outside of work and not work related. My son also works at this company. Outside work I was told that this man said my son would never grow up to be a man because I babied him. I do not even talk to my son at work because they charge him $5.00 if they even think he has talked to me.
I was friends with this man that made the remark. I called him at home
from my home. I asked the man why he said that my son would
never be a man because I babied him. His reply was I do not feel like
Talk about this right now we will talk about this at work. I said no we will
Not. I have not talk to this man since.
The man who made this compliant has claim that something else occurred. How do I handle and clear my name?
I have worked for this company for 5 years.

Trying to do anything about this will only make things worse. He stated his opinion. Under the laws of this country he is entitled to do that, even if you do not agree.

My question for you would be is it legal in the state of New Mexico
to be written up for something that did not occur at work?

Yes, it would be legal in all 50 states. The law does not dictate to the employer what they can and cannot write up an employee for.

Um, they charge him $5.00 every time he talks to you? What is that all about? Are they deducting it from his paycheck?
