I Was Hired In At A Salary Rate In Aug. Of 2005 It Is January Of 2006 And I Took My First Day Off, Due To Rushing My Father To The Hospital. My Employer Split My Salary And Cut My Pay 1 Day. Is That Legal? I Work Overtime And I'm On Call 24 Hrs Every Other Week. I Well Deserve My Salary And Then Some. I Thought The Only Benefit To Having Salary Was That If You Did Need To Miss A Days Work You Were Still Paid The Same. Can Someone Justify This For Me?

First of all, please use standard capitalization and punctuation in your posts. When you capitalize every word, it makes your post very hard to read.
Salaried is only a pay method. What matters is whether or not you are exempt or non-exempt. If you are non-exempt, you never have to be paid for time you did not work. I agree that it would be foolish to designate a non-exempt employee as salaried and then cut their hours when they do not work, but there are only very few, very state specific circumstances in which a non-exempt employee has to be paid when they do not work. If you are exempt, there are only very limited circumstances in which your salary can be cut. Unfortunately, this is one of them. If you take a day off for personal reasons, it is legal for them to dock you for that day. |
