Can an employer withhold his employee's paychecks if paperwork, such as accident reports are not immediately faxed to them? My husband's company is trying to create this new policy, but not only would the person responsible for the paperwork have their check withheld, but several other employees as well.
Second, is it mandatory for an employee to offer you time off if you are required to work so many days in a row? For instance, my husband is a full-time, hourly employee, and works every other weekend with no days off during the week to compensate. So he works 12 days straight, then 2 days off. On the weekends that he is required to work, he is not given any days off during the week to compensate. |

No, an employer is not allowed to hold an employee's paycheck if paperwork is not submitted promptly. If the check is not released within the limits required by state law, the employee can file a complaint with the state DOL.
Whether or not an employee must be given time off after working x days in a row is state specific. But even in those states that do have such a rule, 12 days in a row is still within those limits. |
