I was wondering if someone could help me. I need to know if I can make a claim with the labor commision. A little while ago I was in charge of the mill in a certin cabinet shop. I asked to be moved to some place else because of a back injury I got a couple years back. My boss told me that if he was to move me that they would have to drop my pay. I was at the time making $11.65 an hour. My boss told me that they would pay me $8 an hour. We finally agreed on $10 an hour. I was supposed to also get a raise in January. He told me that I was also supposed to keep up the mill in order to get the raise which was not kept up. I signed a contract for that. I got food posining at the begining of this month and I'm supposed to get a week paid vacation. When I went back today, I asked if they could pay me from my vacation for the days I missed last week. My boss told me that I was supposed to ask in advance for my vacation. In order for them to pay me for that, I would have to work in the mill until the end of January and I would get my pay for the time off then. Please help me as soon as possible. This all began in the middle of December 2004 and I know that I can't wait to long to make a claim with the Labor Commision. Thanks again.

Show your contract to a local attorney. We can't comment on a contract we have not read.

Title 34, Chapter 28, Payment of Wages, outlines the requirements for paying wages to employees and articulates employer's responsibilities regarding paydays, final paychecks, electronic payroll deposits, lawful deductions, wage disputes, and payroll records. This Chapter also outlines the authority of the division in enforcing the provisions of the chapter and specified the penalties for violating the provisions of the Chapter. The Chapter also makes it illegal for an employer to retaliate against an employee for filing a complaint with the Division.
If you have a dispute over wages with your employer, you may file a wage claim with the Employment Standards Bureau. Use the link below to download a claim form. http://www.ind-com.state.ut.us/Utah_..._standards.htm
