Angry Husband not paid last check nor overtime

My husband left his job on Saturday that was his last day of work that week he worked a total of 48.5 hours..Well Monday comes around and we go to get his last check, his boss refuses it to him.. Swaers he has his tools my husband is a mechanic and has paper work for all of them... Tells him he isnt gonna pay him till his tools are returned ( we had none) and truth to be nawn that my husband felt sorry for the guy and left him a few tools, even his secratery said he hasnet done inventory since other employees have been there.. Well his boss owes him over 2,000 in over time i told him i was calling labor board and he cussed me and kicked my off his business property and I had small children in the back.. Then he is giving tool guys my husbands number ( my husband was getting his payments taken out of a cc automatically) after the boss man tells him that my husband isnt gonna pay them.. Not true ... Then he says that my husband must do a free motor job for him cause this other mechanic that the boss man hierd messed up a motor in a pathfinder.. and since the boss man had to pay to have it fixed ( keep in mind hubby didnt work on this pathfinder and even did the free labor to fix it) and has even gave him money to go towards it ( hubby had a good heart) now there saying he owes them more money on that..we live in nc and hubby quit cause the guy was imposing on him to leave me and my kids, and go to nudity bars with him made him feel uncomfrontable what can we do

Final payment in North Carolina is not legally due until the regularly scheduled pay day for the pay period which includes the employee's final day. When that date passes, and your husband has not been paid, HE (not you) can file a claim with the state Dept. of Labor.
