Hi - could someone clear up how vacation time works for exempt employees in Ohio? It was once explained to me that if an exempt employee (let's say 4 direct-reports to clarify status) does not report to the office but is checking email and voice mail throughout the day they are "working" and thus is NOT required to take a vacation day.
Also, is there a website that documents the exempt v. non-exempt specifics for Ohio somewhere? Thank you so much! |

Ohio defaults to federal law for exempt/nonexempt classification:
http://www.dol.gov/esa/regs/complian...a_overview.htm As far as calling in, checking emails while on vacation, personally I would consider that "working". However, I know many exempt employees who do it anyway and do not expect to be changed to a work day instead of a vacation or sick day. I actually have never called to ask this question. If you want to pursue it, you can contact the federal Dept. of Labor and see what they say. |
