I understand that VA law does not require employers to give "meal breaks" I also understand that anything under 20 minutes is paid, however does the federal law supersede state law when someone works over a certain amount of hours? Must they take a lunch break if for example they work 8 or more hours?

Federal law does not require breaks either. Federal law only says that IF breaks are offered, a break of less than 20 minutes must be paid.
If you are working in VA, nothing in either Federal or state law requires that you be given ANY kind of a break no matter how many hours you work. Personally, I think it's foolish for an employer not to allow periodic breaks. I think everyone works better for an occasional break. But the fact remains that nothing in Federal law and nothing in the law of your state requires them to offer one. It's not a question of Federal law overriding state or state overriding Federal - it's simply that the breaks are not required. |
