i am a concerned husband trying to find out info on my wifes maternity leave.
She works for a large company that says she has maternity leave but we dont know who pays us the state or the company.Second is she plans to go back to work butttttt i know once she sees are first child she will change her mind. i know her and were not dependent on her pay. With saying this does she have to go back for insurance or anything like that and will she have to pay her leave pay back if she does not return. please help thank you |

Your wife needs to ask her employer.
Under both the federal Family and Medical Leave Act (FMLA) and the New Jersey Family Medical Leave Act (NJFMLA) your wife is entitled to 12 weeks of unpaid leave. NJ is one of a handful of states, however, that has state temporary disability insurance for pregnany-related disability (up to four weeks before the birth and for six weeks afterward for a normal delivery, longer if there are complications). It would pay a percentage of her salary. Her employer, however, may offer a short-term disability insurance that provides longer coverage, replaces her salary at a higher level, or supplements the state plan. Thus, the first place for her to start is with her employer's HR office. Under FMLA, while she is on leave the employer must continue her health insurance benefits. It can require her to pay the percentage that she would pay if she were working (the amount that is normally withheld from her paychecks). If she decides not go back to work, under FMLA the employer can then require her to repay the full amount of her health insurance premiums. Not all employers do this, but they are legally allowed to. |
