My Daughter was employed by a temp agency in NJ for a year. After working for that year the company she was placed with moved the office out of the state. She was not offered another assignment by the temp agency, so she was out of a job. She applied for unemployment and received 2 checks. She was then notified that her unemployment was being denied because the temp agency said she voluntarily quit her job. Now the NJ unemployment office is trying to make her repay the monies she received from them. She appealed but was denied because temp agency stated she quit her job. What are her rights and can she appeal the decision again?

Was there a hearing on the denial?
If so, did she appear? If not she may have waived her right to further appeals. If she did attend and a ruling was issued against her, she does have a right to appeal to the Board of Appeals (w/in the Dept of Labor). In either event, she should contact the DOL as there are specific time limits in which to appeal. Good Luck!! |
