The reason I asked is that I was trying to see if the Family and Medical Leave Act would apply, because it applies to employers who have 50 or more employees. I'm honestly not sure how FMLA would treat this situation, and it may well be that your employer is considered a separate entity for legal purposes. If FMLA does not apply, then your employer does not have to hold your job for you. I would suggest contacting the U.S Department of Labor for advice/information on FMLA issues.
Whether or not an attorney would take your case depends on whether he/she would feel that you have a viable case. It certainly wouldn't hurt to have a consultation with an employment lawyer. You can go to www.martindale.com to locate attorneys in your area. Since there are no laws requiring severance pay, there are no laws about when it should be paid. I would go ahead an apply for unemployment and see what happens. |
