does anyone know the law of unused vacation pay in north carolina. i was layed off on 10/28/2005 and have yet to get the check for it and was told we would get paid for any unused vac pay. the hr dept. told me on 11/15/05 it would be two more weeks. i thought the law was it should be paid at time of separation or next regular pay day. any advice on this matter would be very helpful.shouldnt i get it before any severance pay which i start getting next week? |

North Carolina employers are required to pay out unused vacation upon termination unless they have a posted policy or practice to the contrary. North Carolina also requires that final wages must be paid to a terminated employee no later than the next regular pay day. Presumably, that includes vacation pay as well.
