Question Hurt then laid off same day

Hi,
I was hurt at work, fell off defective ladder on 10/14/05, and was laid off after the injury.
Not because of it though. This happened in New York.
I filed for unemployment whiling waiting for the workers comp. process to start. The employer was notified immediately after the injury. They cntacted me shortly thereafter the accident and said they don't consider the accident a comp. case but a first aid situation that has been resolved. Thats why I filed the unemployment claim because it seemed the comp. issue would take awhile to sort out.
I haven't received any determination from the comp. carrier yet regarding controverting or accepting my claim.
I have a comp. lawyer at this point and have received a case number and thats about it. Saw a doctor and am awaiting wrkrs. comp. approval from the carrier for x-rays etc.....

My question is.....how does the unemployment benefit I have received so far effect my comp claim? I know your supposed to collect from the day of the accident if it exceeds 7 days. I'm up to aprox. 5 wks. at this point.
Will I still receive those 5 weeks of comp. benefits for the injury?
I know once I'm technically on comp. I have to, and will, notify NY unemployment and get off of unemployment benefits and switch to comp.
Also how long does the carrier have to notify me of their determination?
Thanks for any info. anyone may provide.
