negative time adjustments for break overages
My employer has a policy wherby they negatively time adjust for break overages in a 7 day work week. The way they calculate and keep track of break time however is for an entire pay period. We get paid twice a month the 15th and the 24th. For example: I work a 40 hour week. So I get 30 min of break a day (baring any long lunches reducing my allotted break time). This adds up to 150 min of break time for a 5 day work week. If I randomly go over this allotted time for the week I am negatively pay adjusted for the time over. Now the way break time is kept track of is on a pay period basis. So if I am over on my allotted break for 1 week, but under for the pay period I am still negatively pay adjusted for the overage. My view on this is if I end up under for the pay period I basically gave the break time I didn't use to the company. I was on the clock for the break time I didn't take; being productive and making the company money. Yet they still take the break overage for 1 week of a pay period out of my check. I don't find this very fair at all. We also get "pointed" for the overage which can affect reviews and employment status. IE: 6 points and you're fired. Is this legal for them to do?
