I have a question regarding the VA Employment Laws regarding Paid Time Off (vacation time). I am a FT salaried employee and we get 13 PTO days per year. My supervisor/branch manager has made an executive decision to not allow anyone more than 7 business days off at one time, unless there is an extreme situation. Is this legal?
My family went to Hawaii for our last vacation; however we had to cut it short due to my job would not allow me 2 full weeks off. I feel this is not fair. We should be allowed to use our vacation days as we see fit. I even requested to take the additional 3 days off without pay of asked if I could use sick time; however I was denied. Is this legal for my supervisor to limit my time off? I emailed our corporate office and received a confidential reply regarding our companies polilcy. It states that our supervisor approves PTO based on our office needs; however the VA State Employment Laws override the company policy. Please advise. Frustrated- vacation deprivation Lisa38 |

My supervisor/branch manager has made an executive decision to not allow anyone more than 7 business days off at one time, unless there is an extreme situation. Is this legal? Completely.

Is this legal for my supervisor to limit my time off? Yes. Your employer doesn't have to provide a paid vacation/PTO benefit to begin with. If they do so, then they set the rules as to how and when it's used. Vacation is taken at the convenience of the employer, not the employee. I emailed our corporate office and received a confidential reply regarding our companies polilcy. It states that our supervisor approves PTO based on our office needs; however the VA State Employment Laws override the company policy. Yes, VA laws would override company policy as would federal law but there are none that apply. The vast majority of employers have policies that limit the length of time an employee can schedule as vacation time off and how many employees can be gone on vacation at any one time. I agree that a policy that limits that limits the number of consecutive vacation days an employee can take to seven would be frustrating but it's not remotely illegal. |
