Default owed vacation pay ?

I was recently terminated (10/3/05) from my position after 9 years. Reason was company wanted to "move in a different direction". I was advised at the time I was to be paid my full prior weeks salary/bonus,1/2 day salary/bonus for day I was terminated and my 2 weeks unused vacation pay. I was advised I would receive all on regular payday (friday 10/7) but when I picked up my check the vacation pay was not included. I was advised the accountant "must have forgotten" to cut the check,then told he was "off today" and I would have to wait until the General Manager returned from lunch for the OK to cut the check. Then told 1 hour later he would be late returning from lunch and I would get my check delivered at the end of the day. Later that day received a phone call saying the check would have to come from the payroll department from the out of town main office. Other than getting the run around, am I legally owed this vacation pay ?

PA law does not require that vacation time be paid at termination; only that the company follow their own policy. So it will depend on what your company policy says.

Unless the company policy specifically says that vacation will be paid with your final check, there is nothing illegal about cutting the vacation check in the next pay period.
