Default Being Forced Out a Position

I started working at this company as a temp in March 2004 covering for the CPO's assistant who was on maternity leave. In April 2005 the HR Administrator quit her job and I started doing a big part of her job which had to do mainly with Equity Incentive Plan Administration. In August 2004 I was made an offer to be HR Assistant (non-exempt). My offer letter was vague and did not itemize my duties as Assistant to CPO and EIP Administrator. In Ocober 2005, we hired a temp to work as the CPO's assistant while I dedicated more time to EIP; in December 2005 she was made an offer and I could dedicate myself totally to EIP. The person before me, who did exactly the same thing I do, held a non-exemp position and made 60% more than me. I can prove better results, process improvement and speak three languages fluently. My offer letter/contract was never revised so officially my title never changed, even though my boss made me business cards with the title Coordinator, HR.
There have been 4 people in this position in the last 4 years. I was told by several people that the reason for this is my boss's excessive control and disrespectful behavior. He is an older man who has very limited understanding of new technology but pretends he knows what he is doing when it comes to it. There have been several instances when he made a fool of himself and in some of those I was the person who stood up and pointed where he was wrong. He does not like working with me because I do not let him control me and because I do not cover up his mistakes. In a conversation I had with him I was open about what I thought of him as a leader/boss and he was very upset. He told me that I thought too much of myself and that my lively personality did not match my current job. He also mentioned that the best person for the position would be one that only takes breaks to go to the bathroom. I believe that the very nature of HR asks for a people person personality.
Now the department is under re-organization, another position will be made available in different HR area. I expressed my interest in the position and was told by my boss that would be a possibility (I would not report to him). Several weeks went by and I kept asking about the position available. I got no answer. In a final attempt to get an answer, I wrote an email asking for a review of my offer letter/job description and also the job description of the other position. I received no answer. Three weeks later I resend the email and 15 minutes later was called into the CPO's office for a meeting with him and my boss. They told me that I was not working well in the position I was and that I did not have the qualifications for the other position I was hoping to get. They told me that they would try to find me another position within the company but my feeling is that they want to cover up a mistake they made. They are literally forcing me out of the position I now hold.
I have been documenting all my duties and successes in my current position. My co-workers love working with me and I have improved many of the processes, I can prove that.
This has been a great source of stress for me and I feel I am being punished for fighting for my rights.
Can they force me out this position? Do I have a case if they try to fire me? I have never received a written warning about anything and all I remember not going so well was a project in the beginning of this year which I worked with my technology-challenged boss. The result was perfect though, the process was the nightmare...
Please advise!

nyc13, please start your own thread with the details of your own situation instead of hijacking a thread that is over three years old. Thank you.
