If I am out of work. I have a doctor's release. My employer health nurse is aware of my situation and has contacted my manager. I have been called twice by my supervisor and asked if I am OK, how did my tests come out, and if I will return to work on Monday. Do I have a reasonable expectation of privacy here?

Reasonable, yes. But it is also reasonable for the employer to make sure you are fit to return to work. Nothing you have posted appears to be an illegal invasion of your privacy.

Our employee health nurse is supposed to handle all issues of this nature and report to managment. As once a supervisor myself, I was instructed not to call anyone who was out due to illness and ask why. Nor were I allowed to ask when they will return. That went through the nurse.

Okay, but that's a matter of company policy. If your supervisor wants to call you directly to ask about your medical status, he or she has not violated any laws.

Different rules apply if you have a work comp case. There, the employer and its agents are prohibited from most contacts with your doctor's office. However, they can get your medical notes from the doctor, among other things. HIPAA does not apply in work comp cases.

I would really, really prefer that people stop re-opening threads that have been dormant for months.
If you want to ask a question about the law discussed in the thread, fine. If you are the original poster and want to post an update, fine. But nothing is accomplished by adding still another reply to a post that most likely is no longer being checked for new answers. |
