Default Docking Salaried Employee

My husband works as a salaried manager. He works 12 hours a day and some weekends. Occasionally, he may take the morning off to stay with a sick child so I can work a half day because I am hourly. They have docked his pay for this. Also, they have docked a full once when he needed an extra day to rest because he was returning from military duty. When he does take time off, he usually is being called by other mgrs, or route drivers, secretaries etc. I assumed if you were salaried that some time off here and there was paid because you are always working overtime that you dont get paid for. I am not sure if he is exempt or nonexempt salaried employee but I know that he worked a Sat for a meeting and did not get paid so I believe is is exempt. Does anyone know what NC has to say about docking his pay this way?

Default Exempt

If he is exempt, he should not be docked a partial day (though they can reduce his vacation or sick pay to make up the difference). You can read about exemption at: http://www.dol.gov/elaws/esa/flsa/screen75.asp
