Default Rescinding a Resignation

Need some guidance over an attempt to rescind my resignation. (This is in Colorado) I submitted a letter of resignation about 8 weeks ago, which was to be effective July 1. About two weeks ago, I asked to rescind my resignation. My employer just got back to me yesterday and advised that my request to rescind my resignation has been denied on the basis of "performance issues". She did not cite any specifics on these alleged "performance" issues, and never once before have I ever been spoken to or written up about anything having to do with my work performance. As a matter of fact, all of my performance reviews since the beginning of my employment have met and/or exceeded the agency standards. I actually work for a County government agency, but still assume they would have to substanciate this denial by fact?

I don't believe that you have recourse, unless you can get someone to assist you within the county, such as a human resources department. If they refuse, I believe you are going to have to move on.

I have seen this happen before. Sometimes (and I'm not saying this is true in your case), a person will submit a resignation in the heat of the moment...perhaps a fit of frustration or anger. Later, they regret the resignation but it is too late.

I agree with Lillian. Once you submit a resignation, you have no protected right to rescind it. If the employer doesn't wish to allow you to rescind it, they don't have to; nor do they have to defend their decision.

While Lil and CBG may be correct, your employer does not have the right to lie. If you can prove what was said and prove your performance is other than what they said, you should stand a chance at defamation of character or making libelious/slanderous remarks. IIRC both of these can be criminal as well.

I'd suggest whipping out a few bucks and discuss this with a lawyer.

The poster is going to need far more than the statement suggested before he or she is going to have a slander claim.
