I currently am a part time hourly employee. I work 3 conse. days and on average 10 hours per day. I have not been taking my half hour lunch, but rather working through it and am getting paid for it as well. I just recently received a raise
but with a condition attached. I was told it was mandatory that I take the half hour lunch. Why, I'm not hungry and get alot more done let alone it sorta defeats the whole raise bit. Anyway, what is the law in Michigan. Thank you |

Hi,
There is no Federal mandate and there is no law in Michigan requiring paid Lunch Breaks. If not taking a lunch puts you in an overtime status, and your employer does not want to pay you overtime pay, then they can set your hours to include an unpaid lunch and / or breaks. http://www.dol.gov/esa/programs/whd/state/meal.htm |
